  • ENGI-MONOGATARI has created the following Guidelines and Terms of Use so that more fans can engage in derivative works in a safe and enjoyable environment.

  • Regarding Derivative Works

    The term "Derivative Works" as used in these Guidelines ("Derivative Works") refers to illustrations, videos, songs, and other derivative works (including but not limited to illustrations, videos, and songs) created using ENGI-MONOGATARI-related content.

  • Commercial Use

    If you wish to create, use, or exploit derivative works as a corporation or as an individual creator who receives payment (commercial use), please be sure to contact us in advance using the inquiry form.

  • Non-Commercial Use

    Permission to create, publish or distribute derivative works for non-commercial use is not required. However, you are required to follow these guidelines for such non-commercial use.

    • *Small-scale use within the scope of a hobby of an individual or circle member for free or for a profit at a level equivalent to the cost of raw materials is considered non-commercial use.

  • Non-Commercial Use with Special Exception

    In order to allow as many people as possible to use this content, permission from this project is not required if you are earning advertising revenue by posting as an individual or in a doujin circle within the terms of non-commercial use described above.
    The same applies if you open a paid channel as an individual or in a circle and earn income from affiliate advertisements, money earned by Superchat or other means, or incentives from creator incentive programs. However, the guidelines must be followed.

  • Use of Derivative Works of this Project

    Please be advised that ENGI-MONOGATARI may use the published derivative works on social media platforms and other works deemed necessary for this project.
    Upon publication of the Derivative Works, you grant the Project and third parties designated by the Project permission to use the Derivative Works within the scope of the Project's business in a manner determined by the Project, free of charge and without limitation as to location, region, or period of time. (In addition, the work may be trimmed a certain extent as long as the identity of the work is not unrecognizable.)

  • Other

    Please acknowledge the following terms regarding the production, use, and exploitation of the Derivative Works.

    • (1) Not to infringe on the copyrights or honor of third parties.

    • (2) Do not engage in any acts that damage the honor or dignity of the characters.

    • (3) Not to be used for acts or purposes offensive to public order and morals, violent, sexual, antisocial acts, specific beliefs, religions, or political statements.

    • (4)Not to be used in such a way as to mislead people into believing that it is an official product.

    • (5) The Project shall not be responsible for the creation, use, exploitation or any other matters related to the Derivative Works. The Project shall not be liable for any damages incurred by you in connection with the Derivative Works, and you may not make any claim against the Project.

    • *The Project reserves the right to withhold fan content activities and use of fan content in order to protect copyright and moral rights in this content not limited to the terms and conditions.

    • *If the content of this project is used as is, or if it is merely modified and lacks creativity, it cannot be considered a derivative work, and the general guidelines do not apply.

  • ENGI-MONOGATARI Character Usage Agreement

    These terms and conditions of use (hereinafter referred to as the "License") define the range and conditions of use of the character "ENGI-MONOGATARI" (the Character), for which the ENGI-MONOGATARI Project (hereinafter referred to as the "Project") holds the rights, when used by the User. By using this character, the user agrees to all the terms of this license.

  • Article 1 Definitions

    In this License, the terms listed in the following section shall be as defined in the respective section.

    • (1) Character
      A pictorial work created to express an abstract concept that is given a name or otherwise characterized by voice, appearance, personality, etc., in order to distinguish it from others.

    • (2) The Character
      The character "ENGI-MONOGATARI" for which the Project owns the rights subject to these Terms of Use.

    • (3) Derivative work
      A work created by translating, arranging or transforming, adapting, filming or otherwise adapting a work.

      A work that is created by altering, changing, or otherwise modifying a work and that does not constitute a derivative work.

    • (5) Derivative Work
      means, collectively, modified and derivative works and other works created in reliance on a copyrighted work.

    • (6) User
      A person who uses the Character or its derivative works, in whole or in part.

  • Article 2 Relationship to Copyright Law and Other Applicable Laws

    • 1. The Character is protected by copyright law and other applicable laws.

    • 2. This license does not prevent users from using the Character as generally permitted under the Copyright Act and other applicable laws and regulations.

    • 3. This Project owns the copyright of the modified version of this character.

    • 4. Based on Article 28 of the Copyright Act, this Project exclusively owns the same types of rights as those held by the author of the derivative work among the rights in Articles 21 to 27 of the Copyright Act regarding the use of derivative works of this character.

  • Article 3 License and Conditions of Use

    • 1. The Project shall grant the User a non-exclusive license to the following actions by the User following the terms of this license for this Character.

      • (1) To create derivative works of this character.

      • (2) Reproducing, performing, screening, publicly transmitting, exhibiting, or distributing derivative works of the Character created by the User.

      • (3) Using all or part of the name of the Character or the nickname in the title, description, etc., of the Character's derivative work created by the User or giving the derivative work a unique name using part of the name of the Character.

        2. In using the action of the preceding paragraph, the user shall comply with all the terms of use listed in the following items.

      • (1) Do not infringe on a third party's intellectual property rights or any other rights and honor.

      • (2) Do not engage in any act that damages the honor or dignity of this character.

      • (3) Do not use the information for acts or purposes that are offensive to public order and morals, violent expressions, antisocial acts or purposes, or specific beliefs, religions, or political statements.

      • (4) Do not use the product in a misleading manner as if it were an official product of this character.

      • (5) Do not use it for any other act the Project deems inappropriate.

      • (6) Prior approval shall be obtained from the Project for commercial use.

    • 3. The User shall not be able to sublicense the rights granted by this Project under this License to a third party.

  • Article 4 Termination of License

    • 1. If a user violates this License, the license usage granted to the user will be automatically terminated.

    • 2. Except as provided in the preceding paragraph, this License will terminate at the same time as the end of the protection period of rights under the Copyright Act related to the Character.

    • 3. Notwithstanding the preceding two paragraphs, the Project may suspend or terminate this License at any time. From this time, no new use based on Article 3, Paragraph 1 will be permitted.

    • 4. The use of this Character and its derivative works by the user may be deleted or discontinued at any time based on the free will of this Project.

    • 5. This Project shall not be liable for any damage incurred by the user due to the discontinuation of the use of this Character or its derivative works under this article or the termination of this License of the derivative work.

  • Article 5 Disclaimer

    • 1. The User shall use this License after agreeing to the following items in advance, and this Project shall not be liable for any damage caused to the User due to any of the following items.

      • (1) The Character, whether expressed or implied, is provided by the Project in its possession at the time of provision.

      • (2) The Project does not guarantee that there are no errors, bugs, defects, or other defects in this character.

      • (3) The Project does not guarantee any suitability, usefulness (benefit), security, title, non-infringement, accuracy, etc., for the purpose planned by the user.

    • 2. The User agrees that the Project shall not be liable for any damages (including cases where the Project has been identified to be liable for the possibility of damages) incurred in connection with the use or inability to use the Character.

  • Article 6 Modify of License

    The Project may change the contents of this License as deemed appropriate. When the Project changes the License, the Project shall notify the User of the change by posting it on the website (URL: https://engi-monogatari.com/), and the User's use of the License after the notification of the change shall be deemed to have agreed to the changed Terms of Use.

  • Article 7 Governing Law, Court of Jurisdiction, Language, Others

    • 1. This License shall be governed by the Japan Act, and the Tokyo District Court shall be the exclusive jurisdiction court of the first trial.

    • 2. This License shall be original and Japanese and shall always be construed solely by Japanese. Translations into other languages are for reference only, and in the event of any discrepancy between the Japanese version of this License and the translation, the Japanese version shall prevail.

    • 3. All rights not stated in these Terms of Use regarding these characters are reserved to this Project.

  • Privacy Policy

    ENGI-MONOGATARI (hereinafter referred to as "the Project") recognizes the importance of appropriately protecting the personal information of service users (hereinafter referred to as "Users") when providing various services and complies with the Act on the Protection of Personal Information (hereinafter referred to as the "Personal Information Protection Act") and other related laws, regulations, and guidelines. In addition to complying with the Act on the Protection of Personal Information (hereinafter referred to as the "Personal Information Protection Act") and other related laws, regulations, guidelines, etc., we have established the following privacy policy (hereinafter referred to as the "Privacy Policy")

    In the event that the handling of personal information is outsourced to an external contractor, the Company shall select a contractor that is capable of adequately protecting personal information and shall supervise the contractor appropriately.

  • 6. Confirmation, modification, and deletion of personal information

    If a user requests disclosure, correction, deletion, suspension of use, etc., of the user's personal information, this project will confirm the identity of the user and will not be required to disclose, etc., based on laws and ordinances. We will promptly respond to this unless otherwise stated. However, we may refuse to disclose information other than personal information if it interferes with our business.
